Privacy Statement for Registration to and Use of Nantucket Chronicle's Online Discussion Forums

Any person ("You" or "Your") using or accessing Nantucket Chronicle's Online Discussion Forums which includes all comments on any postings to the Nantucket Chronicle website (the "Discussion Forums"), including the submission of any postings, questions, comments, any other content, or any personal information, explicitly consents to such use of Your information as set forth in this Privacy Statement and agrees to the terms of this Privacy Statement.

Nantucket Chronicle, LLC (“Nantucket Chronicle” “We” or “Us”) started the Discussion Forums to enable You to interact with and ask questions regarding Nantucket and Your Nantucket experiences.  Nantucket Chronicle knows that You care how information about You is used and shared, and We appreciate Your trust that We will do so carefully and sensibly.  We take Your privacy very seriously and make it a priority to protect personally identifiable information that We obtain from You, such as Your name, email address, mailing address and/or telephone number.  Please take a moment to review this Privacy Statement (“Privacy Statement”) which describes how Nantucket Chronicle collects, uses and shares such information as part of the Discussion Forums.

By using or accessing the Discussion Forums web pages (whether or not You have registered), You are accepting this Privacy Statement.  If You do not want information about You to be used in the manner set forth in this Privacy Statement, please do not use the Discussion Forums.

The Discussion Forums is not intended for persons under 18 years of age.  We do not knowingly collect personally identifiable information from persons under 18 years of age.  The Discussion Forums is intended for U.S. residents only.

What personal information does Nantucket Chronicle collect?

Nantucket Chronicle may collect personal information when You use or access the Discussion Forums.

In order for You to submit content, such as postings and comments, and ask questions through the Discussion Forums, We will ask You to register and provide certain information.  When You register, We may ask for information such as Your full name, Your address, Your e-mail address, Your telephone number, and a password.  You should always keep this information correct and updated—such updates can be made on Nantucket Chronicle’s Discussion Forums web pages after You have logged in to Your Discussion Forums profile.  From time to time, We may also ask You to provide other information, especially if Your question relates to Your accounts.   If You choose to provide such information, You are giving Nantucket Chronicle the permission to use and store it consistent with this Privacy Statement.  Therefore, please understand that when You sign in to the Discussion Forums, You are not anonymous to Us. 
In addition, while You access and use the Discussion Forums, Nantucket Chronicle automatically receives and records information from Your computer and browser, including Your IP address, software and hardware attributes, the page You request, and cookie information (for more information on cookies, please refer to the section titled “What are cookies, and how are they used to collect information?”).  You also give Nantucket Chronicle permission to use and store such information consistent with this Privacy Statement.

Can anything I submit within the Discussion Forums, such as a Comment made through the Discussion Forums, become publicly available?

Yes.  If You post content or a question through the Discussion Forums, or use a comment area, a bulletin board or any other means of making Your views known through the Discussion Forums, You should be aware that any information You share is visible to other users.  Personally identifiable information You submit as part of a posting, comment, question or other submission to the Discussion Forums can be read, collected, or used by other individuals to send You unsolicited messages.  Nantucket Chronicle is not responsible for the personally identifiable information You choose to submit through the Discussion Forums.  Nantucket Chronicle will assume that every piece of information You put in a submission to the Discussion Forums can be posted publicly on the Discussion Forums web pages.  Furthermore, You should operate under the assumption that once You release information publicly through the Discussion Forums, it will remain public, even if You later attempt to delete it.  It is for this reason that We ask You never to put Your name, account numbers or any other personally identifiable information anywhere in Your postings or questions.  Nantucket Chronicle already has certain personally identifiable information from You as part of Your registration and can contact You if We need more information.

Furthermore, to the extent Nantucket Chronicle ever permits the upload of content to the Discussion Forums, if You release any personal information within any content that You upload to the Discussion Forums, You are making that information available to the general public and Nantucket Chronicle is not responsible for keeping that information private.

What are cookies, and how are they used to collect information?

A cookie is a piece of information which a web server may place on Your computer when You visit a web site.  Cookies are commonly used by web sites to improve the user experience and have not been known to transmit computer viruses or otherwise harm Your computer.  Many cookies last only through a single session, or visit.  Others may have an expiration date, or may remain on Your computer until You delete them.

We use cookies for a number of purposes—for example, to maintain continuity during a user session, to gather data about the usage of the Discussion Forums for research and other purposes, to store Your preferences for certain kinds of information, or to store a username or encrypted customer identification number so that You do not have to provide this information every time You return to the Discussion Forums. 

Our cookies will not track Your other internet activity.  Cookies set by Us cannot be read by and are not shared with any non-Nantucket Chronicle web site, although We may share some of the cookie information We gather with Nantucket Chronicle affiliates for non-marketing purposes.  Our cookies typically do not gather personally identifiable information.

We occasionally use other companies to set cookies on Our web sites and gather cookie information for Us.  In some cases We will also use another company to operate web servers for Our sites.  We use the cookie information gathered by these companies in the same manner as stated above.  The companies We use may not use these cookies for their own internal purposes or share the information gathered with anyone other than Nantucket Chronicle, in accordance with the terms of the contracts they have signed with Us.

We may use cookies and similar tools to relate Your participation in the Discussion Forums to personally identifiable information obtained from You, and to obtain anonymous aggregated data.  Nantucket Chronicle enables cookies for sign-on as part of session management.

If We send You information about Nantucket Chronicle's services or promotions, We may use cookie, click stream, or other data about Your activities within the Discussion Forums to allow Us to limit the materials We send You to items that We think You will find interesting.

If an error occurs on Nantucket Chronicle's web systems while You are using the Discussion Forums, Nantucket Chronicle's servers may automatically collect and store information relating to that error, including Your browser information, information from Nantucket Chronicle cookies, and other information that You may have inputted at the time the error occurred (for example, information You had written into any web forms).  Nantucket Chronicle uses this information to investigate the error and help prevent future errors.

Does Nantucket Chronicle collect anonymous aggregated data, and what does Nantucket Chronicle do with it?

Anonymous data is information (originally personally identifiable or non-personally identifiable) that subsequently is used in aggregate form.  We may use anonymous data for purposes of research or analysis.  We may conduct research on Our customer demographics, internet usage, and interests and behavior based on personal data We gather.  Although anonymous data may be based in part on personal data, it does not identify You personally.  Nantucket Chronicle may share this type of anonymous data with a variety of third parties, including its affiliates, advertisers and other current and prospective business partners.  But because it is anonymous, these third parties will not be able to contact You based on this data.

We may use anonymous data collected for website administration, advertising and promotional purposes, and We may share such information with various affiliated and unaffiliated entities for such purposes.  For example, IP addresses are used for the purposes of system administration and to provide anonymous aggregated data to advertisers about the volume of use of the Discussion Forums.  We may also enter into agreements with outside companies that possess the technology that allows Us to customize the advertising and marketing messages You receive while participating in the Discussion Forums.  Your non-personally identifiable information and click stream data about Your activities may be shared with these companies so this customization can be accomplished.  Our agreement with these companies restricts them from sharing Your information with third parties or using it for any other purpose.  Anonymous click stream and demographic information may also be shared with Our advertisers and business partners.  We do not give any outside company personal bank account, investment account, or credit/debit card account information for any marketing or promotional purposes whatsoever.

How does Nantucket Chronicle use my personally identifiable information?

Nantucket Chronicle collects personally identifiable information in order to establish and enhance Our relationship with You.  Also, it helps Us deliver a first-class user experience.  Nantucket Chronicle’s use of this information includes the following general purposes: contacting You, customizing the content You view, fulfilling Your requests for Nantucket Chronicle products or services, answering Your questions, improving Nantucket Chronicle products and services, conducting research, and providing anonymous reporting for internal and external clients.  We only collect personally identifiable information from You because You are voluntarily submitting the information to Us in order to enjoy certain parts of the Discussion Forums.

We may also collect certain information such as banking, credit/debit card, and other account information if Nantucket Chronicle or any Nantucket Chronicle affiliate needs such information to answer specific questions about Your account.

We will use the personally identifiable information You provide to Us in a manner that is consistent with this Privacy Statement.

We will not share any of the personally identifiable information We collect or receive from You based on Your participation in the Discussion Forums to any non-affiliated third-parties or to Nantucket Chronicle affiliates for their marketing purposes.  We may, however, share Your personally identifiable information with Nantucket Chronicle affiliates for servicing, administration, or processing purposes with respect to Nantucket Chronicle products or services, or products or services offered by Our affiliates.

Similarly, We may share Your personally identifiable information with companies that provide services to Us, including outside contractors or agents who help Us operate the Discussion Forums.  We may also share Your personally identifiable information with other people or entities in order to provide goods or services that You have requested or to complete a transaction at Your request.

There may be instances when We may disclose personally identifiable information without providing You with a choice in order to protect the legal rights of Nantucket Chronicle or its affiliates, and each of their respective investors, directors, officers, employees, agents and suppliers.  These instances may include, but are not limited to instances: to protect the safety and security of users of the Discussion Forums; to enforce Our Terms of Use to comply with the law or comply with or respond to a subpoena; to comply with Our intellectual property policies; or, to protect against fraud or for risk management purposes.  If You submit a Notice of Copyright Infringement pursuant to the Terms of Use, We will send a copy to the person or entity who uploaded, stored or transmitted the material addressed by the communication.  If You are the person accused of copyright infringement, and You submit a "Counter-notice" under the Copyright law in response, We will send a copy to the person or entity who submitted the original Notice of Copyright Infringement.  Similarly, allegations of trademark infringement and any responses to allegations of trademark infringement may be disclosed without Your prior consent.  If We sell all or part of Our business, or make a sale or transfer of assets, or are otherwise involved in a merger or business transfer, We may transfer Your personally identifiable information to a third party as part of that transaction.

This Privacy Statement is Our primary disclosure to You of when and how Your information may be used.  At times, however, We may choose or be required by law to provide You with additional notice.  Whether or not You request or ask not to receive communications from Nantucket Chronicle, We reserve the right to send You administrative messages, service announcements, and other similar communications, without offering You the opportunity to opt out of receiving them.  This is important in case We need to communicate with You about items such as Your account, website maintenance, and other non-promotional matters.

What about other websites?

From time to time, web pages on the Discussion Forums may refer or link to a Nantucket Chronicle affiliate or third-party websites or state the url or domain name of a Nantucket Chronicle affiliate or third-party website.  Nantucket Chronicle is not responsible for the information collected by those affiliates or third-parties, and does not know the privacy policies of those affiliates or third-parties.  Nantucket Chronicle is not responsible in any way for the privacy policies of affiliates and third-parties and You should check such privacy policies to see how those affiliates and third-parties use any information they collect.

Is the personal information collected about me secure?

We use reasonable physical, electronic, and procedural measures to safeguard personally identifiable information in Our possession against loss, theft and unauthorized use, disclosure or modification.

We limit access to personal information about You to Nantucket Chronicle and Nantucket Chronicle's agents whom We believe reasonably need that information to provide Our products or services to You or to do their jobs.

We have also implemented reasonable measures to help protect Your personal information from loss, misuse, or unauthorized access or disclosure.  Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure.  As a result, while We strive to protect Your personal information, We cannot guarantee its security.

You can help Us by taking precautions to protect Your personal data when You are using the Discussion Forums.  Change Your passwords often, and make sure You use a secure web browser.  Do not use any personally identifiable information in Your User Name or Display Name or in Your submissions to the Discussion Forums and do not pick a password that can easily be figured out by someone else such as a birth date or a child's or pet's name.

What happens when Nantucket Chronicle changes its Privacy Statement for the Discussion Forums?

From time to time, Nantucket Chronicle may revise this Privacy Statement to reflect industry initiatives or changes in the law or to the scope of the Discussion Forums, among other reasons.  If under any such update We make any material change to the way in which We treat Your personal information, We will inform You of such change by posting a notice on relevant areas of the Discussion Forums web pages.  Any revisions will be effective upon posting the new Privacy Statement.  Therefore, it is important to check the effective date of the Privacy Statement posted at this location each time You visit the Discussion Forums to ensure that You are familiar with the most updated policies and practices.  If You do not agree with any changes to the Privacy Statement, You must discontinue any use of the Discussion Forums.  Any visit to the Discussion Forums web pages or use of or participation in the Discussion Forums by You after the new Privacy Statement is posted will indicate Your agreement to the new Statement.
